Terms of Service

These terms are an agreement between you and 1001085583 Ontario Inc., an Ontario corporation operating as ExamElephant ("ExamElephant," "we," "us") covering your use of examelephant.com and the ExamElephant study platform (the "Service"). By creating an account or using the Service you agree to them. If you don't agree, please don't use the Service.

1. What the Service is

ExamElephant is an exam-preparation study tool: original practice questions, simulated exams, spaced retesting, explanations, and study analytics. It is an educational aid only. We do not administer certification exams, and using ExamElephant does not guarantee any exam result, score, or credential.

ExamElephant is independent. PMP is a registered mark of the Project Management Institute, Inc. ExamElephant is not affiliated with, endorsed by, or sponsored by PMI or any certifying body. All practice questions are original works written to publicly available exam content outlines; they are not actual exam questions.

2. Your account

• You must be at least 16 years old to use the Service.
• Provide accurate information and keep your password secure. You are responsible for activity under your account.
• Accounts are personal: one account per person, and sharing an account (or reselling access) is not permitted.

3. Free access and paid passes

• Every account is currently on the free tier, which includes a limited portion of the question bank and limited daily features, as described on our site. We may adjust free-tier limits over time.
• Paid passes are not on sale yet. If you join the paid-pass waitlist, we will email you when they open. Joining is free and commits you to nothing.
• When paid passes open, paid access will be sold as one-time passes (for example Sprint 30, Prep 90, Pass Plan), each granting full access for its stated number of days from purchase. Passes are not subscriptions and never auto-renew.
• The Pass Plan includes free extensions of access until you report a pass, requested in good faith through your account while preparing for the covered exam, up to a total of 12 months from the date of purchase. Extensions are granted in 30-day steps; the final one is shortened to end at the 12-month limit rather than being refused.
• Passes are personal to your account and non-transferable.

4. Payments and refunds

• When paid passes open, payments will be processed by Stripe. We never see or store your full card details.
• Prices are shown at checkout and may change for future purchases; applicable taxes may be added.
• If something isn't right, contact support@examelephant.com within 14 days of purchase. We review refund requests in good faith. Nothing in these terms limits any non-waivable statutory refund rights you may have.

5. Acceptable use

Because the value of the Service is the question bank, these rules matter. You agree not to:

• copy, scrape, harvest, export, publish, or redistribute questions, explanations, or other content, whether manually or with automated tools;
• use the content to build or train a competing product or a machine-learning model;
• share accounts, circumvent free-tier limits or access controls, or probe the Service for vulnerabilities;
• upload content you don't have the right to share (see section 7);
• use the Service in violation of any law or certification body's exam policies.

We may suspend or terminate accounts that violate these rules.

6. Our content

The Service and all its content — questions, explanations, cases, exhibits, software, and design — belong to ExamElephant or its licensors and are protected by copyright. We grant you a personal, non-exclusive, non-transferable license to use the content for your own exam preparation while you have access. No other rights are granted.

7. Content you upload

Some accounts (for example, instructors and creators) can upload their own questions or materials. If you upload content:

• you confirm you own it or have the right to share it, and that it does not reproduce actual exam questions or other parties' copyrighted test-prep materials;
• you keep ownership, and you grant us a license to host, display, deliver, and analyze it as needed to run the Service (including aggregated performance statistics);
• we may remove content that we believe infringes rights or breaks these terms.

8. AI-assisted features

Parts of the Service, including question drafting and the ElephantGPT explanation assistant, use artificial intelligence. AI output can contain mistakes. Explanations and readiness estimates are study aids, not professional advice, and we encourage you to check anything that looks off — our review pipeline exists for exactly that reason.

9. Honest outcomes

Readiness scores and forecasts are statistical estimates based on your practice history. They are not promises. We never guarantee that you will pass any exam.

10. Termination

You can stop using the Service or ask us to delete your account at any time. We may suspend or terminate access for violation of these terms; if we terminate a paid account without cause during an active pass, we will refund the unused portion pro rata.

11. Disclaimers and liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, ExamElephant's total liability for any claims arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect, incidental, consequential, or exemplary damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Changes to these terms

We may update these terms as the Service evolves. If a change is material we will give notice (for example by email or an in-app notice) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated terms.

13. Governing law and contact

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. If you use the Service as a consumer, you keep any protection that the law where you live gives you and that cannot be waived by contract. Questions about these terms: support@examelephant.com.
